Arrested for Robbery in Colorado?

Colorado statutes defines robbery as knowingly taking anything of value from a person by use of force, threats, or intimidation. Force or fear is the main element of robbery. Simply taking something but not using force or fear could be classified as theft.

The state of Colorado recognizes three types of robbery:

  • Robbery – Colorado Class 4 felony offense that is punishable by up to 6 years in prison and a fine of up to $500,000.
  • Aggravated Robbery: robbery that involves the use of a deadly weapon – prison time of up to 32 years and a fine of up to $750,000.
  • Aggravated Robbery of a Controlled Substance – prison time of up to 48 years and fines up to $750,000.

If you have been arrested for robbery in Colorado, it is important to begin building a swift defense against these serious charges. There are several defenses your Boulder criminal defense attorney could use to fight these charges. Some of those include:

  • You did not intend to steal anything
  • The property was yours
  • You did not have a deadly weapon
  • You had no intention of using a weapon even if you had it on your person
  • An illegal search and seizure

Unfortunately, charges of robbery are very serious and without an attorney on your side, you could face a long time in prison. Your attorney will need to build a solid and swift defense that is designed to expose the holes in the prosecution’s case. In many cases, your attorney can have the robbery charges reduced or even dismissed altogether. Without an attorney, however, your future could be in jeopardy.
