While the DNA evidence was available at the original trial for the 1989 crime, advances in the ability to analyze and handle DNA in the intervening years allowed for a new examination of the evidence, which not only points away from the man originally convicted, but toward another man who is currently serving time for another similar crime. The defense attorney for Robert Dewey has said that his client is handling the situation extremely well, but that he is concerned for Mr. Dewey&#8217;s future. The man who the DNA evidence now points to would currently be eligible for parole from the other crime in 2035.</p>

			<content:encoded><![CDATA[<p>Two people have been injured and a Colorado man is dead after a horrific car accident in Las Vegas, Nevada over the weekend.</p>
<p>According to the <a title="Officials ID driver from Colo. killed in Las Vegas crash" href="http://www.denverpost.com/news/ci_20165377/nhp-ids-driver-from-colo-killed-vegas-crash?source=rss" target="_blank">Denver Post</a>, the man killed was 24-year-old Donnie Myron Jones of Cortez, Colorado. Jones was exiting the freeway in his Pontiac Sunfire when he collided with a Chevy Tahoe. The driver of the Tahoe was reported to have received only minor injuries while Jones&#8217; passenger was said to be in the hospital in critical condition. The accident occurred around 6:30 a.m. Sunday morning. Investigators from the Nevada Highway Patrol believe alcohol may have been a factor in the deadly crash.</p>
<p>DUI related crashes kill about 170 people every year in <strong>Colorado</strong>. A five year average for Nevada puts the number of alcohol related deaths in that state at about 132 per year. The blood alcohol content threshold set by the state of Colorado is 0.08. During a trial in which Ms. Rochester&#8217;s defense was that she was not guilty by reason of insanity, she had two psychiatrists testify that she was insane at the time of her crime. One of those psychiatrists worked for the defense team, while one worked for the state mental health hospital. The prosecution asked the judge to allow them to hire a doctor to examine Ms. Rochester, but their request was denied. The District Attorney&#8217;s appeal of the decision would not affect the Rochester case, but if successful, it would set a precedent for similar cases in the future.</p>
<p>Something that is interesting concerning this issue is brought up by Pat Furman, a law professor at the University of Colorado. Mr. Furman says that because the psychiatrists at the state mental health hospital work for the state, they essentially represent the state.
