10.32.010. Curfew—Exceptions.

A. It is unlawful for anyone under the age of 18 years to be or remain in or upon any street, alley, park, playground, schoolyard or other public area between 11:00 p.m. and 5:00 a.m., Sunday through Thursday, or between 12:00 midnight on Friday and Saturday and 5:00 a.m. of the following day.

B. It is an affirmative defense that the defendant is:

1. Engaged in, or traveling directly to or from, lawful employment; or

2. Accompanied by a parent or guardian, or other person of the age of 21 years having permission of the parent or guardian, to have the custody and care of such minor; or

3. Accompanied by any person between the ages of 18 years and 21 years having in his or her possession written permission from the parent or guardian to have the care or custody of such child; or

4. Upon an emergency errand or legitimate business directed by the parent, guardian or other adult person having the care and custody of the minor; or

5. Attending, or traveling directly to or from, a religious service.

10.32.020. Caretakers and custodians of minors—Permitting violation.

It is unlawful for the parent, guardian or other adult person having the care and custody of a minor under the age of 18 years to knowingly permit such child to be or remain in or at any street, alley, park, playground, schoolyard or other public area between 11:00 p.m. and 5:00 a.m., Sunday through Thursday, or between 12:00 midnight on Friday and Saturday and 5:00 a.m. of the following day. The affirmative defenses in section 10.32.010 apply to this section.
